In a devastating roadway accident, a California gas company driver struck a motorcyclist stopped at a red light and dragged him while pinned underneath his pickup truck. The motorcyclist stayed lodged under the moving vehicle for at least 430 feet on a busy suburban street. It required the help of other motorists to surround the truck before its driver finally stopped.
The driver pleaded guilty to a hit-and-run charge, but the 30-year-old motorcyclist, also a recent newlywed, found his future irrevocably changed as a result of his devastating injuries. He sued the truck driver’s employer for relief. The jury found the gas company liable for its driver’s actions and awarded the motorcyclist $46 million in damages, as reported by the Insurance Journal. The harm caused to his right leg after scraping the street may eventually require amputation. To begin healing from the accident, he required numerous surgeries and blood replenishment of nearly 40% of his body’s supply.
Based on the investigative report, the truck driver had an epileptic seizure while driving for the gas company. His doctor advised him not to operate a vehicle and he took medication for it after a previous experience left him with a suspended driver’s license. Allegedly, the gas company was aware of his condition, but permitted him to operate a pickup truck as part of his employment.
According to the National Highway Traffic Safety Administration, the number of motorcycle fatalities decreased by 3% during the year 2017, which is when this life-changing collision occurred. Motorcycle crashes are, however, nearly 28 times as likely to end in fatalities as crashes involving passengers riding in a vehicle. Recovering from severe and life-changing injuries due to a devastating motorcycle collision may require a civil action to obtain full and just compensation.
